1. Acceptance of Terms

By accessing or using AI Channel Creator ("the Service"), operated at aichannelcreator.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

AI Channel Creator is a software-as-a-service platform that enables users to create YouTube videos using artificial intelligence. The Service generates scripts, voiceovers, images, and fully assembled videos, and can upload them to YouTube on your behalf.

The Service integrates with third-party providers including the YouTube Data API, OpenAI (GPT-4, DALL-E, TTS), ElevenLabs, and Stripe for payment processing.

3. Account Registration

To use the Service you must create an account by providing your name, email address, and a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

AI Channel Creator offers the following subscription tiers:

• Free — $0/forever: 2 videos/month, 1 channel, basic voices.
• Pro — $29/month: 20 videos/month, 5 channels, premium voices, auto-upload.
• Business — $99/month: Unlimited videos and channels, all voice providers, API access.

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel. Prices are subject to change with 30 days' notice.

5. User Content and Ownership

You retain ownership of the content you provide to the Service (topics, scripts, channel configurations). AI-generated content (scripts, voiceovers, images, videos) produced through the Service is owned by you, subject to the underlying rights of third-party AI providers as described in their respective terms of service.

You grant AI Channel Creator a limited, non-exclusive license to process your content as necessary to provide the Service.

6. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

7. YouTube API Services

The Service uses the YouTube Data API to upload videos on your behalf. By using this feature you also agree to be bound by the YouTube Terms of Service and Google Privacy Policy.

8. Intellectual Property

The Service, including its design, logos, software, and documentation, is owned by AI Channel Creator and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, original, or free from third-party rights.

10. Limitation of Liability

To the maximum extent permitted by law, AI Channel Creator and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service at our discretion if you breach these Terms or our Acceptable Use Policy.

Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable retention period. Sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Channel Creator operates, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
